The 6th Dist. Ct. of Appeals has granted K's request to stay the injunction during the appeal of the trial court's decision. This may take a year or longer, and in the meantime, K will continue to sell and support their current systems.:)

Excellent news. As a fan of world cinema the ability to import DVDs is very important to me.

Well now maybe a realistic settlement can be worked out by the parties, that's a logical upside to the stay, IMO.

So this knocks off potential action for at least 12 months, and the DVDCCA might still lose the appeal.

Even if they win, they have to show damages, which is a completely separate trial.

So even if things went perfectly for the DVDCCA from this point forward, we are talking about, what? 24 months until this issue is resolved?

And to be clear, even if- at that point- Kaleidescape was forced to stop selling DVD capable systems- 24 months from now, how many DVDs will actually be on the shelves at Best Buy? I think by then we will have 4K bluray, which I would imagine K will be able to handle with vaults and updated players.

I think K has successfully dodged the DVD issue as part of their business model affecting the sale of systems. But- does anyone know what damages could possibly be awarded- any thoughts on that if K does ultimately lose?

I think 5+ years from now, you will see just as many DVD's on the shelves at Best Buy as you do right now...IMHO
 
Yeah, Amazon might be in danger of losing their showrooms...

Seriously though, I think that perhaps the DVD CCA will have to come up with a better settlement than:

"Close your business, cease all technical support for existing customers, set fire to your engineering staff and shoot the CEO's dog."
