I believe he just put "Kaleidescape" in his title so that his item would appear if someone was searching for Kaleidescape. Not an egregious crime, actually quite common on ebay... list similar things in your post to get more search hits.
 
I think so as well Josh. K emailed me and they are looking into it. It (K) is trademarked, but I also don't think anyone would be confused into thinking what he is selling is in any real way connected to K.

I think they should've said "like kaleidescape" or something in the title, but again, this is common on eBay and nothing to be alarmed about IMO. I'd actually be surprised if K did anything.
 
The listing was cancelled by Ebay. I dont think you are allowed to mention another companies name in your title or description.
 
Not sure why the listing was pulled. K may or may not have been involved, but they certainly have the right to have their name removed from the listing.

I'm not sure what happened to the listing, but it was clearly improper. The listing person was suggesting that the server had some association with Kaleidescape. It's no different if the person had said "Apple, Buffalo, Kaleidescape 15 TB server." If I sell a plain leather wallet can I suggest that it's from Coach, Gucci or some other company? I found that listing when it was up because I searched for Kaleidescape. I wasn't looking for a non-kaleidescape server or other component, I was looking for Kaleidescape. That's what makes the listing improper under Ebay's guidelines or otherwise.

There was clear confusion as to source, and that, in a general sense is what trademark law is all about.
