Kaleidescape Faces DVD CCA in Court Monday; Fair Use at Stake

Just the next step in this saga. Not likely to resolve anything in the short term, as both sides are likely to appeal a loss. This will just push a final outcome well into 2008/09. In the meantime we will all continue to sell, install and enjoy the K-system! :)

this has always seemed to me to be something the CE members of the CCA have pushed because someone created a terrific interface for this and now they would (I am assuming) have to license it. They view it as cheaper to squash a (relatively) little company. Just my take. If they were sooo against this to begin with, why even make an agreement with Kaleidescape in the first place?

This article provides a better overview of some of the issues involved in the lawsuit. I think Malcolm is right - the concept of "authorized copy" for DVD frustrates the very purpose of fair use in copyright law. Only authorized replicators seem to have the ability to make authorized copies.

Forgetting the legalities for a moment, I think the practical reality in the marketplace will be some form of fair use will always exist. I understand the legal nuances here,but I think the CCA should allow this. Most people I know who have copied DVDs to their computer think its completely fine to do so- when I tell them they have broken the law they can't believe it. They have. Believe it. I am not so sure where this court will come out on this. I wish Kaleidescape the best not just because Im a customer but because I personally agree with their position.
